    Contenuti

    Durante le lezioni verranno illustrati e discussi gli argomenti di Diritto Penale focalizzando l’attenzione sul principio di obbligatorietà ed efficacia della legge penale, sulla struttura del reato, sulla responsabilità degli enti e la condotta. Ancora, verranno trattate la colpevolezza, l’imputabilità e cause di esclusione. Verranno poi illustrati i principali argomenti relativamente ai reati contro l’incolumità pubblica, reati ambientali responsabilità corporativa ex D.lgs 231/2001.

    Obiettivi formativi

    Lo studente deve acquisire le conoscenze di base relative ai principali argomenti di Diritto Penale. Lo studente deve acquisire inoltre le conoscenze necessarie ad individuare le responsabilità in relazione alle condotte individuanti i reati ambientali e le conseguenze giuridiche che ne derivano.

    Programma del corso

    1. Principio di territorialità. L’efficacia della legge penale nello spazio;
    2. Il principio di obbligatorietà;
    3. L’efficacia della legge penale rispetto alle persone;
    4. La struttura del reato: definizione di reato distinzione dagli altri illeciti;
    5. Distinzione tra: delitti e contravvenzioni, oggetto giuridico e danno nel reato;
    6. Soggetto attivo del reato e concorso di persone nel reato;
    7. Responsabilità degli enti per illeciti dipendenti da reato;
    8. La condotta; l’omissione; i presupposti della condotta; la coscienza e la volontà dell’azione;
    9. Cause di esclusione della coscienza e volontà; classificazione dei reati in base alla condotta;
    10. Distinzione dei reati in base all’evento; rapporto di causalità;
    11. La colpevolezza, l’imputabilità e cause di esclusione: minore età, infermità di mente, stati emotivi o passionali, sordomutismo;
    12. Fatto commesso sotto l’azione di sostanze stupefacenti e incapacità preordinata di intendere e di volere;
    13. Reati contro l’incolumità pubblica; Reati ambientali legge n.68 del 22.05.2015;
    14. Inasprimento normativo e il reato d’inquinamento ambientale art.452-bis c.p.;
    15. Morte o lesioni come conseguenza del delitto di inquinamento ambientale art.452 ter c.p.;

    During the lessons the topics of Criminal Law will be illustrated and discussed, focusing attention on the principle of mandatory and effective criminal law, on the structure of the crime, on the liability of institutions and conduct. Again, the culpability, imputability and causes of exclusion will be discussed. The main arguments regarding crimes against public safety, environmental crimes corporate responsibility pursuant to Legislative Decree 231/2001 will then be illustrated.

    Course objectives

    The student must acquire the basic knowledge related to the main topics of Criminal Law. The student must also acquire the knowledge necessary to identify the responsibilities in relation to the conduct identifying the environmental crimes and the legal consequences deriving from them.

    5. Distinction between: misdemeanors and offences, legal object and damage in the crime;
    6. Active subject of the crime and competition of persons in the crime;
    7. Responsibilities of institutions for criminal offences;
    8. Conduct; omission; the assumptions of conduct; conscience and the will of action;
    9. Causes of exclusion of consciousness and will; Classification of offences by conduct;
